Pending Dispute Alleges Misrepresentation, Unsuitability

Firm Settled 2010 Dispute

The above-described dispute is not the only one in Mr. Jyotishi’s record. In 2010, another party of investors lodged a claim alleging that he misrepresented a variable annuity income rider. In 2012, his former member firm settled the dispute for $20,000.

Brokers Must Make Suitable Recommendations

Misrepresentation describes a broker’s provision of inaccurate and/or misleading disclosures concerning an investment recommendation. The misrepresentation of material information—that is, information that represents a significant consideration to investors—generally contravenes FINRA Rule 2020. Under this rule, brokers may not use “any manipulative, deceptive or other fraudulent device or contrivance” as they go about performing securities trades. When they do, they put their clients at risk of making unsuitable investments.
