Understanding FINRA’s Suitability Standard

It’s worth deconstructing of the allegations involving Mr. Robertson, as they describe forms of investment fraud that all investors should watch vigilantly for. Unsuitable recommendations are those that aren’t tailored to a customer’s particular needs. As you may know, when an investor opens an account, their broker ascertains their profile. This includes such factors as the customer’s investment experience, investment goals, liquidity needs, income, net worth, risk tolerance, and more. Using this information, the broker must exercise reasonable diligence to determine whether potential investments or strategies are suitable for the customer. A long-term investment in an illiquid, speculative oil and gas venture, for instance, likely wouldn’t be suitable for a customer with a conservative risk tolerance and/or near-term liquidity needs.
