Pending Dispute Seeks $400,000
On June 17, 2024, an investor lodged a dispute alleging that Mr. Storzinger violated FINRA rules. It specifically alleges that he violated Rules 2010, 2020, 2111, and 3280. In addition, the dispute alleges that he engaged in negligence and that he breached contract. The claim seeks $400,000 in alleged damages.
FINRA Rules Prohibit Undisclosed Private Securities Transactions
The allegations involving Mr. Storzinger relate to several vital securities industry standards:
- Rule 3280. This rule prohibits brokers from engaging in private securities transactions without providing prior written notice to their firm. This notification must “describ[e] in detail the proposed transaction and the person’s proposed role therein.”
- Rule 2111. Under this rule, brokers must recommend investments or strategies which they have a “reasonable basis to believe” are suitable for their clients.
- Rule 2020. This rule prohibits brokers from using “manipulative, deceptive or other fraudulent” devices in the transaction of securities.
- Rule 2010, under which brokers must “observe high standards of commercial honor and just and equitable principles of trade” in the conduct of their business.
Past Dispute Alleged Unsuitable Investment
The above-described pending dispute is not the only one in Mr. Storzinger’s record. On June 30, 1997, another investor filed a dispute alleging that he recommended an unsuitable investment. His former member firm settled the claim for $10,000. A comment appended to the disclosure asserts that Mr. Storzinger “was not the representative who was responsible for any losses and or securities violations.”
