Pending Disputes Seek More Than $1 Million
In 2024, four parties of investors filed disputes involving Mr. Maller that are still pending. All four detail allegations that he recommended unsuitable investments in oil and gas products. The claims, which are still pending, cumulatively seek $1.35 million in alleged damages.
Broker Issues Statement Defending Against Allegations
Mr. Maller defended himself against the above-described allegations in comments appended to each of the pending disputes’ disclosures. “Almost every client involved has reached out to me to assure me that this is not an indictment of me but rather Lincoln for making this product available,” he wrote in these statements. “The Attorneys involved have also assured these clients that the focus here is on Lincoln and not Peter Maller. These are some of my best clients and best referral sources.” In addition, he wrote that the clients have not stopped working with his firm, and that some have added assets to their accounts.
Past Dispute Stemmed from Atlas Growth Partners
In addition to the pending disputes, Mr. Maller’s BrokerCheck profile describes four disputes settled by his former member firm. These claims also detail allegations of unsuitable oil and gas investment recommendations. One specifies that it stems from an investment in Atlas Growth Partners. His former firm settled the disputes for a total exceeding $550,000.
Broker Asserts Investment Was “Small and Appropriate”
Mr. Maller also issued statements defending himself against the settled claims. With regard to allegations that he recommended an unsuitable investment in Atlas Growth Partners, he asserted that the investment comprised a “small and appropriate percentage” of the customer’s portfolio. “The oil markets unexpectedly imploded after the investment and did not recover for several years,” he asserted, which led to the product’s poor performance. “We diversity our clients’ investments so that if one investment does not perform as anticipated, the portfolio as a whole still performs.”
