Pending Disputes Stem from REIT Sales

In 2024, two parties of investors lodged disputes involving Mr. Swinson. In both cases, the investors alleged that he recommended an unsuitable real estate investment trust, or REIT. The disputes, which are still pending, seek unspecified alleged damages.

Settled Dispute Also Concerned REIT

On November 15, 2023, another investor filed a dispute involving Mr. Swinson. In this claim, the investor also alleged that he recommended an unsuitable REIT. On January 21, 2025, his former member firm settled the dispute for more than $13,900.

What Are REITs?

A real estate investment trust, or REIT, is an entity that owns assorted forms of real estate, or interests in real estate. As an investment product, REITs use the combined funds from a pool of investors to purchase real estate property; they can be publicly traded or privately held, traded on the stock market or not traded at all. Non-traded REITs are generally highly illiquid investments. While they have the benefit of extending new opportunities to investors who otherwise could not access certain real estate investments, non-traded REITs may be particularly risky for short-term investors and even long-term investors. Investment professionals who recommend unsuitable REITs may be subject to disciplinary action or investor disputes.
