Pending Disputes Stem from Fraud Allegations

Between 2022 and 2024, eight parties of investors filed disputes involving Mr. Kimber. The disputes allege, among other things, that he was “indirectly involved” in a former partner’s fraud, that he “indirectly benefited” from the fraud, and/or that he failed to identify the fraud. While one of the disputes was withdrawn, seven others are still pending. As his BrokerCheck report reflects, they seek more than $37 million in damages.

Jason Kimber Defends Against Allegations

In statements included with several of the above-described disputes’ disclosures, Mr. Kimber denied the allegations. “Due to my prior association to my former partner, this client alleges that I should have been aware of his alleged fraud,” reads one of these statements. “I was not. My former partner conducted these activities as an outside business activity. I was unaware of his actions. My former partner acted without any association or involvement from or by me or my firm.”

The statement proceeds to assert that Mr. Kimber did not participate in or benefit from his former partner’s fraud. As he wrote, “I did not know about it until I was contacted by the SEC in June 2022.”
