In November 2023, two parties of investors filed disputes involving Ms. Tur. In both cases, the claimants allege that she made unauthorized trades in May of the same year. The disputes, which remain pending, seek unspecified damages.
FINRA rules prohibit brokers like Ms. Tur from engaging in unauthorized trading. Rule 2020[2], for example, holds that they may not employ manipulative, deceptive, or other fraudulent means to conduct securities transactions. Then there’s Rule 3260[3], which prohibits discretionary trading in cases where the broker has not first obtained written authorization from the client and approval from their firm. Finally, Rule 2010[4] mandates that brokers, in the course of their business, observe high standards of commercial honor and just and equitable principles of trade.
Ms. Tur’s employer, Merrill Lynch, has been involved in more than 800 investor disputes that evolved into arbitration proceedings, according to its BrokerCheck profile[5]. A 2009 dispute, for instance, alleged misrepresentation and unsuitable investment recommendations, resolving with an award to the claimant of $435,000. That same year, another claimant alleged suitability violations and negligence in a dispute that resolved with an $880,000 award. In 2011, an unauthorized trading dispute resolved with an award to the claimant of more than $2.5 million.
Clarisse Tur launched her career as a broker in 2012, when she registered with Merrill Lynch’s office in Akron, Ohio. She remains there to this day. With 11 years of experience as a broker, she has completed three industry exams, including the Series 66 and the Series 7.
